Terms and Conditions
1. The promoter is Carnival plc trading as P&O Cruises, Carnival House, 100 Harbour Parade, Southampton SO15 1ST (Promoter, we or us).
2. These terms and conditions apply to the Promoter’s Talent of Tomorrow Competition (the Competition) and are available at www.pocruises.com/talentoftomorrow. By completing the entry form you will be deemed to have read and understood these terms and conditions and to have agreed to be bound by the same.
Competition Stages
3. The Competition will consist of the following stages: (A) Submission Period, (B) Audition Period, (C) Finale and (D) Announcement.
A. Submission Period: Entries may be submitted from 10.00am on 29 July 2024 (Opening Date) until 11.59pm on 11 August 2024 (Closing Date) inclusive.
B. Audition Period: A shortlist of ten entrants will be contacted by the Promoter as soon as practicable following the Closing Date to attend an audition in Southampton on 31 August 2024 in front of a panel of experts which will include an independent expert.
C. Finale: Three finalists will be chosen to attend a 1-2-1 session with Gary Barlow on 7 September 2024. Gary Barlow will watch the finalists perform and offer coaching and mentoring to help refine performance skills. Following this, the three finalists will be subject to a public vote hosted on the Promoter’s digital channels where the winner will be determined.
D. Announcement: the Winner will be announced on stage on board Iona in Lisbon on 10 October 2024 and stay overnight, returning to the UK on 11 October 2024.
How to Enter
4. To take part in this Competition you must visit the Promoter’s Talent of Tomorrow Competition page at pocruises.com/talentoftomorrow, click ‘Enter now’ and complete the entry form during the Submission Period. As part of the entry form you will be required to include a YouTube link to your audition performance, ensuring the video is set to public or unlisted and hosted on your own YouTube channel (the Audition Video).
5. Your Audition Video:
a. must feature you singing;
b. must feature you playing an instrument live (it is a condition of entry that all entrants play their own instruments);
c. be no longer than 2 minutes;
d. is not a music medley
e. does not feature any other person singing or playing an instrument (group entries are not permitted), backing track nor any other music or musician (live or recorded); and
f. must have been recorded and uploaded within 2 months prior to the Opening Date of the Submission Period, and must not be edited, distorted or enhanced in any way.
There is no limitation to what that instrument is however you must be able to replicate the performance at audition if required. The Promoter will not be responsible for supplying the instrument and it must be able to travel on a standard commercial flight. However, the Promoter will supply a piano if required, of which the make and model will be the Promoter’s choice in its sole discretion.
6. Your Audition Video must not contain any material which is in any way defamatory, obscene, unlawful, harmful, offensive or inappropriate or which infringes the rights of any third party. You also agree not to advertise or promote third parties' or your own goods or services in your Audition Video. You agree not to endanger yourself or others, take any unnecessary risks in order to produce or make an Audition Video. Please refer to YouTube’s Community Guidelines at https://www.youtube.com/howyoutubeworks/policies/community-guidelines/. Any entries which do not comply will be disqualified.
7. All entries must be received by the Promoter no later than 11.59pm on the Closing Date. All entries received after the Closing Date of the Submission Period are automatically disqualified.
8. Only one entry to the Competition is permitted per person. Multiple entries are not permitted.
9. No purchase is necessary to enter the Competition.
10. Entrants must be available to attend if selected:
a. the in-person audition in Southampton on 31 August 2024 (or an alternative date as communicated by the Promoter);
b. the in-person 1-2-1 coaching session with Gary Barlow on 7 September 2024 (or an alternative date as communicated by the Promoter);
c. the in-person introduction on stage on board Iona in Lisbon on 10 October 2024 (or an alternative date as communicated by the Promoter) and stay overnight, returning to the UK on 11 October 2024; and
d. the prize cruise before the end of May 2025.
11. Entrants who are not available to attend the auditions or take the prize cruise as set out above shall be disqualified.
Promoter’s Right to Use your Audition Video and other Material
12. By uploading your Audition Video you hereby grant the Promoter an irrevocable licence to use, edit, reproduce, distribute, transmit, broadcast, make available and display your Audition Video (or part of your Audition video) (including but not limited to your performance) as well as your name, biographical information, statements, voice, photographs and other likeness (“Entrant Assets”) without charge by any medium or method now known or later invented including without limitation online (organic and paid media) to be exercised in our sole discretion throughout the world in perpetuity. You agree that we may permit other parties authorised by us a licence of your Audition Video and Entrant Assets for their use. You agree to waive and that the director of your Audition Video has waived any moral rights that may exist in relation to your Audition Video.
13. You are responsible for the content of your Audition Video. You promise that you are fully authorised and entitled to upload the Audition Video in accordance with these terms and conditions, and that doing so you will not infringe the copyright or other rights of any third party, or infringe any applicable laws or regulations. You promise that you have all necessary licences, rights, permissions and consents to enable you to upload the Audition Video and to authorise us to use the Audition Video. You agree to give us evidence of such licences, rights, consents and permissions if requested by us. You also agree not to transfer files which contain viruses or other harmful programs. By completing the entry form you are signifying your agreement to these terms and conditions, and consenting to your Audition Video being used for the purposes related to the Competition and any promotion thereof. If you do not accept any of these terms and conditions do not complete the entry form. We may accept or reject your entry in our sole discretion. Nothing in these terms guarantees that we will use or display your Audition Video.
14. You acknowledge that the Promoter will capture certain content during the stages of this Competition which you may feature in as a Competition entrant. If selected, you will be asked to sign a Model and Entertainment Release Form in relation to the Promoter’s capturing and sharing of your audition, image, name and likeness.
The Prize
15. One winner will be selected from the three finalists to win the prize. The prize is a cruise of at least 7 nights, departing before the end of May 2025, for the winner and a guest (aged 18 and above) sharing a Balcony cabin on board one of the Promoter’s ships, Arvia or Iona. The winner will have the opportunity to perform one 45-minute set in The 710 Club on multiple nights. When necessary, the prize will include economy class flights from/to the UK and transfers between airport and the ship for the winner and their guest.
16. It is the responsibility of the prize winner to ensure they and their guest have valid passports and travel insurance, meet all required travel requirements, and obtain any vaccinations and visas required to take part in the Prize.
17. The prize does not include travel between the winners’ home and the UK airport, travel insurance, excursions, luggage fees and personal expenses including on-board spending account. The prize is subject to the Promoter’s booking terms and conditions and any associated travel policies and/or requirements, available on pocruises.com.
18. The prize is non-transferrable, non-exchangeable and no cash alternative is available.
19. Should the prize become unavailable a substitute of equal value shall be provided by the Promoter. The Promoter reserves the right, at their discretion, to replace the prize (or part thereof) with an alternative prize (or part thereof) of equal or higher value. Such alternative prize may take place on board a different vessel or during different dates if circumstances outside the Promoter’s control require.
Winners
20. Audition Video entries will be judged by an independent industry expert by 20 August.
21. During the Audition Period, a shortlist of ten entries will be contacted by the Promoter by no later than 21 August to attend an in-person audition in Southampton on 31 August 2024 in front of a panel of experts. Entrants will be required to perform one song on this date which can either be from a prescribed list provided by the Promoter or an Entrant’s own song. At least three attempts will be made to contact the shortlisted entrants. Should the Promoter be unable to contact the shortlisted entrants within 5 days or should a shortlisted entrant be unable to participate in the Competition for any reason, the Promoter reserves the right to shortlist another entrant, selected in accordance with these terms and conditions. Reasonable expenses will be paid on submission of evidence.
22. After completion of the Audition Period, three finalists will be chosen to attend a 1-2-1 session with Gary Barlow on 7 September 2024 where he will watch the finalists perform and offer coaching and mentoring to help refine their performance skills. Reasonable expenses will be paid on submission of evidence. Finalists will be required to perform a song prepared from a prescribed list or the finalist’s own song. Following this, the three finalists will perform a further audition of up to 3 minutes which will be recorded and shared on P&O Cruises official digital channels (organic and paid) and will be subject to a public vote hosted by the Promoter where the winner will be determined based on the finalist who received the most public votes.
23. The Promoter will announce the winner on 30 September 2024.
24. In the event it is determined that any entrant is ineligible or subject to disqualification for any reason, then that Entrant will be disqualified, and the entrant who received the next most public votes will be a candidate for the prize.
25. The winner must continue to comply with all terms and conditions of this Competition, and winning is contingent upon fulfilling all requirements.
26. Winner will be introduced on stage on board Iona in Lisbon on 10 October 2024. The Promoter will organise return flights and a hotel for the winner on the night of 10 October 2024, and will pay reasonable travel expenses upon submission of evidence.
27. If no suitable entries are received, the Promoter may cancel the Competition in its sole discretion.
Eligibility
28. The Competition is only open to all UK residents aged 18 or over. At all times during the competition period and audition stages and Entrants must have a valid passport, travel insurance and able to travel to Portugal.
29. Current and former employees of Carnival plc (including group companies), either shoreside or on board, are not eligible to enter the Competition.
30. Entrants must be able to demonstrate to the Promoter’s satisfaction that they do not have any agreement(s) in effect that would prohibit an entrant from fully participating in the Competition including but not limited to a talent contract.
31. No bulk or third-party entries will be accepted. The Promoter will not accept entries that are automatically generated by computer; illegible, have been altered, reconstructed, forged or tampered with or are incomplete.
Limitation of Liability
32. There are certain things for which the Promoter does not accept any liability to you. The Promoter cannot exclude or limit its liability for death or personal injury caused by its negligence, or loss caused by a false statement where the statement is made fraudulently. Otherwise, the exclusions described below will apply.
33. The Promoter does not accept responsibility for network, computer, hardware or software failure of any kind, which may affect the sending, receipt or processing of your entry.
34. The Promoter will not be liable, at any time, to any entrant for loss or damage unless it is caused by its negligence or the negligence of our agents or employees.
35. YouTube is not a sponsor of this Competition, and entrants should release YouTube from any liability related to this contest.
Personal Data
36. The Promoter will use the personal data you provide for the purpose of administering this Competition and to facilitate the redemption of prizes. Personal data will be processed in accordance with the Promoter’s privacy notice available at www.pocruises.com/privacy
37. The surname and county of the prize winner will be available from the Promoter by sending an email including the name of the competition to competitions@pocruises.com. If you object to any or all of your surname, county and winning entry being made available, please contact the Promoter at competitions@pocruises.com. In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request.
General
38. If the Promoter has grounds to suspect any entrant or third party of cheating, deception or fraudulent or unsportsmanlike conduct of any kind (including, without limitation, manipulating the Competition, choice of prize winner or any entry) the Promoter reserves the right (in its sole discretion) to disqualify any entrant, entry or person it reasonably believes to be responsible for, or associated with, such activity. The Promoter’s decision in such matters shall be final.
39. The Promoter reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, this Competition with or without prior notice due to reasons outside its reasonable control.
40. These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
